On Thursday December 1, the Minister of Finance, Ngozi Okonjo-Iweala, cringed when the senate joint committee investigating the management of funds set aside for petroleum subsidy handed her a seven-day ultimatum to produce a secret forensic report on the Nigerian National Petroleum Corporation in her custody.
The audit (click to download): Consolidated Detailed Findings-v1, done for her ministry by renowned audit and advisory consultancy, KPMG, which exposed the massive financial malfeasance and monumental corruption in the NNPC, is one document the federal government, the petroleum ministry and the NNPC have worked hard to conceal for a little over a year now.
The report, which could trigger a fierce face-off between the federal and state governments, is one of the most closely guarded secrets in Nigeria today. It contains shocking details of how the NNPC, and by implication, the federal government has been swindling the states.
So when the committee requested Mrs. Okonjo-Iweala to produce it, she became a bit uneasy, knowing that doing so might embarrass the administration and sparked some troubles for the NNPC, a source close to her told the Times. Initially the minister didn’t make any commitment, but when pressed by committee members, she reluctantly acceded to the request.
It is not known at press time whether she has sent the document to the committee. Contacted yesterday, her spokesperson, Paul Nwabuikwu, said he had no information on the matter. Calls to the chairman of the senate joint committee, Magnus Abe (PDP, Rivers), were unanswered. But as at noon today, long after the ultimatum given to Mrs. Okonjo-iweala expired, a source close to the committee said the minister was yet to make the report available. He said there was high-powered lobby by the NNPC not to make the document public.
The damning report
But the Times has scooped the report for you in case the minister fails to produce it or does so to the committee in camera.
As far as the 41-page report is concerned, the NNPC is a cesspool of monumental corruption and fraud. The report detailed the corporation’s sharp business practices, violation of laid down rules and regulations, illegal deductions of funds belonging to the state, and failure to account for several billions of naira that should go to the federation account.
The agency, the report says, has also severely defrauded our country in subsidy claims. Auditors found that between 2007 and 2009 alone, the NNPC over-deducted funds in subsidy claims to the tune of N28.5bn. It has not been able to account for the sum ever since.
The over-deduction from its remittance to the federation account for 2010 and 2011, believed to be in several billions of naira, is not captured in the report.
The Federal Government, through the Federal Ministry of Finance, hired KPMG and another Nigerian auditing firm, S.S. Afemikhe & Co., in July 2010, to look into the books of the corporation following allegations of “wrongful deductions at source by the NNPC to fund its operations” by the 36 state governors.
There were also concerns at the time that “the procedures for managing and reporting the country’s crude oil and gas revenues are opaque and characterized by gaps, overlaps and inconsistencies in the role of key parties responsible for the assessment, collection and reporting on these revenue streams.”
Officials of the petroleum ministry and the NNPC, a source at the finance ministry disclosed, developed cold feet after the auditors were sent in, and indeed tried hard to frustrate the representatives of the two audit firms by failing to supply evaluation criteria for commercial bids submitted in respect of petroleum products importation.
Believing that would turn the auditors away, our source further explained, the corporation also failed to provide them with other relevant documents such as the criteria for allocation of products and product volumes to importers/suppliers and periodic prequalification list of approved products importers/suppliers.
But in spite of the difficulty they faced, the auditors were able to determine that the NNPC had been anything but transparent in the management of our country’s oil resources.
The report that emerged from the audit was just too damning that the leadership of the petroleum ministry, the NNPC and some few other elements in the Federal Government have worked hard to keep it away from the 36 state governors and federal lawmakers in particular and Nigerians in general.
Stealing the states blind
In what is likely to anger state governors, the audit established that the corporation was in the habit of arbitrarily estimating subsidy claims and then over-deducting funds from proceeds of domestic crude sales.
“For example,” the report said, N25bn was deducted as subsidy estimate for September 2009 from domestic crude sales proceeds while PPPRA approved a subsidy of N23.8bn. N35bn was also deducted as subsidy estimate fro November 2009 but PPPRA approved of N21.3bn.”
The auditors’ analysis indicates “over-deduction for these two months amounted to N14.9bn. However, only N4.2.bn was swept into the Federation Account by the NNPC as adjustment for subsidy claimable in the two months.” That is beside the N11.8bn subsidy claim the NNPC claimed it paid for imported products that didn’t reach consumers.
State governors have always complained that the NNPC was shortchanging them through illegal deductions from revenues payable to the federation account.
Fraudulent underhand tactics
Over-deduction is however not the only way the corporation is defrauding the federal and state governments. According to laid down regulations, the NNPC is invoiced in dollars for domestic crude allocations but is expected to remit the equivalent naira value to the Federation Account. But auditors found to their chagrin that in doing that, the corporation used exchange rates far lower than those published by the Central Bank of Nigeria.
Using this “fraudulent underhand tactics”, the NNPC succeeded in cheating the three levels of government of a whooping N85.2bn in three years – N25.7bn in 2007, N33.8bn in 2008 and N26.7bn in 2009.
When the auditors requested explanations for these exchange rate disparities, the NNPC claimed it obtained the exchange rates it used from the CBN via telephone.
The report also severely indicted the NNPC over the shoddy and non-transparent manner it renews crude sale contracts every year. The auditors noted that “evaluation criteria for renewal of contracts are not clearly stated in the contract document”, and that the selection exercises were based on individual discretion and wrong assumptions and criteria.”
The NNPC claims that renewal of contract was based on performance of off-takers (buyers). But the auditors observed that the basis and process for determining performance were not clearly defined.
The auditors wondered why in 2007 and 2008, some companies not on the approved list of buyers for that year were allocated crude, a practice the examiners believe had led to crude being sold to non-credible buyers, even with relevant guarantees and safeguards not implemented.
Specifically the auditors queried the allocation of crude to Ovlas Trading (2, 852,316 barrels in 2007 and 906, 269 barrels in 2008) Petrojam (2,818,914 in 2007), Oil Fields (950,166 barrels in 2007) and Zenon (906,000 barrels in 2008) even when they were not on the list of authorized buyers for that year.
Contracts for the importation of products, the auditors wrote, were also routinely awarded without regard for approved guidelines and procedures. “We observed that contracts for the importation of petroleum products were awarded to companies and suppliers not listed in the approved prequalification list used for the fourth quarter 2008 importation,” the report noted.
The auditors specifically queried the award of contracts in that manner to Astana Oil Corporation Limited, Natural Energy and Oando, when they were not prequalified for patronage that year.
Among other forms of misdemeanour, ranging from poor accounting to shoddy record keeping, the auditors also indicted the corporation for leaving its own storage facilities, unused, and then proceeding to incur additional cost from leasing of third party storage facilities.
The auditors reported that DPK tanks (with storage capacity of 18,000 cubic metres) at the PPMC depots within the Mosimi Area had not been used for three years even though there were in good condition. Yet the corporation, the examiners added, had been leasing storage facilities from third parties.
The spokesperson of the NNPC, Levi Ajuonuma, declined to comment on the report, saying he had nothing to say until the government releases it officially.

As a general comment. It is impossible to say the FG have no say in the NNPC’s operations. The Ministry of Petroleum is in charge of NNPC and cannot claim ignorance or that they did not play their part. Subsidy mismanagement, corruption, allocation of over inflated contracts which never had intention of implementing are all issues within the FG, its agencies and State govs.

It is not a disgrace, it is a correction. I think the reason why the FG initiated the audit was because some quarters are begining to look into that direction. That being said, i must commend this administration for signing the freedom of information bill into law, that law has aided a lot of this revelation you see today and more are still coming. The call of revelation should be at the state level. That being said, the NNPC is a govt agency and if there is any fraudelent activity there, then, the blame falls on the corridor of the FG simple and short.
I think there is a mix up here, NNPC and FG, are they not the same? The audit report just uncovered the fraud that was perpetrated in the subsidy transactions, what is left is for FG to find the people that are responsible for the fraud and prosecute them. In my opinion, NNPC is a parastatal under the FG so they are the same.

How come these “reports” are suddenly available to everybody who has internet access yet is unavailable to the Senate joint committee? If you and I can, at the click of a button, get this information, how come the Government cant or has not? Then, the report keeps referring to NNPC. Is NNPC an entity that is faceless or bodiless? Who writes the documents requesting the deductions, who signs them, who approves them, who makes the tranfers? where do those transfers end up? These are the questions that need to be asked and answered. I do not think it is rocket science. DUH!!!!!

I am completely disappointed at the conduct of people like Livy Ajounuma the supposed PRO of NNPC. This same guy criticized government before joining NNPC and the moment he was appointed, he simply joined the bandwagon instead of exposing the atrocities of the corporation. What a shame!!!
Petroleum Marketers are fighting back by exposing some of the subsidy deals. They say Nigeria must know that Haruna Momoh the MD of PPMC and Deziani Allison Madueke Minister for Petroleum has been demanding and pocketing N50 per litre of Kero and petrol produced by local Refineries since Jan 2011 till date. The reason they gave to marketers is that it was marketers contribution to Jonathan’s election, but it has continued even after the elections. That the govt should probe Nezor SA and Tridax SA two companies owned by the Peroleum Minister run by her junior brother. This two companies in the last 16 month of her tenure has from nowhere become one of the few companies lifting crude oil and one of the largest beneficiary of the subsidy. The marketers want Nigeria to probe the new list of briefcase companies now lifting crude oil because they paid minimum of $1 million to Momoh and Deziani.
The audit report has only helped to further expose some of the underhand dealings through which the FG itself has been conniving with Multinational Companies and even its own Agencies to swindle the nation and put us into Slavery. “ONLY A RADICAL SOCIAL REVOLUTION CAN PUT A STOP TO ALL THESE MESS” AND THE TIME IS NOW!!!

They provided the remit and certainly had ability to decide what info comes out. The issues Being discussed are not isolated, they are at the essence of the countries problems. No agency or ministry so far has delivered anything despite the countries enormous sums that have been spent.

The Finance Minister and CBN must likely have seen monumental fraud and reported it to GEJ. After a thorough investigation, they traced the money to funding of the PDP and their presidential campaigns. Seeing that everyone would likely go down with the Tsunami if uncovered, they simply decided it was better to cover up their tracks and divert attention from the probe.
Their (GEJ Govt) thinking is that if they remove the subsidy, the NNPC, PPPRA and DPR would eventually be merged which will necessitate that they open a clean sheet of books thereby destroying every available documents anyone would ever discover of these corrupt agencies. By then, no one will ask any question and we would simply continue with whatever is left.
I want to sincerely think that God has a hand in this Subsidy removal. The government never knew that so many questions will be asked. They never knew that Nigerians could rise. They never knew that even though they refuse to educate us, we can go at their back and be educated. They simply took us for granted but alas! The Wind has blown and we have seen the buttocks of the mother hen.

could it be that the president acted on this report and decided that ehough is enough? even if this were the case, it was still a hasty decision. it smelt of immaturity on the part of the president to take such a hasty decision. it also points to the fact that a lot of cover up is being done. but infortunately, it is too late now, the people have risen. from debates that have been going on since monday, i have realised that subsidy has to be removed, no doubt about it. but what we as the people are saying is that it would no longer be business as usual. let’s tackle corruption before we remove oil subsidy. that is the only way the people would be rest assured that the money is not wmbezzled like previous funds.
Why suddenly hinging the provision of infrastructures on the availability of subsidy money when it is so clear to everyone that even the budgetary allocation for these capital projects are grossly misappropriated? the government must answer for these before anothr surplus is provided for them to be looted.
let the government do the right thing. plug the loopholes through which public funds are being siphoned, cut down the bogus salary of the government and bring the “cabal” to book.

Paul and others. This is how to interprete financial report. The subsidy funds is part of cost element in d budget book. The FG will summarise the book to state that 1.2t is spent on subsidy whereas the real spend is abt 0.4t. Now that the report has shown how the FG and others re benefitting under that cost element, it is logical to remove it and spread the funds into other elements dat re yet to be investigated so that the looting can continue before Nigerian wake up again.
It is time to favour Zion (Nigeria). The set time has come. Nigerians must however take advantage of this opportunity.

Why is any Agency in Nigeria managed without any oversight? Why is any Agency in Nigeria managed without a yearly full blown Audit? For the article to suggest that the audit was initiated because there were some allegations is mind boggling. Shouldn’t all government Agencies be audited yearly to ensure that they are complying with their mandates—–allegations or not? 3. Must the senate compel Ngozi by an ultimatum before she releases the report?

well it seems some people are not seeing the problem right, removing the subsidy will not resolve the issue. Because if it the same set of people that manage NNPC will continue to manage it then the purpose is defeated. Accountability is needed for a better government. The present Administration is trying but is not competent enough to resolved the problem. Based on this article I will say the government is aware that why they opted for the subsidy removal
I think we all have an idea of the real issues with Nigeria. What we need to do is start talking about the way forward and taking the necessary steps. Perhaps it is time to start asking the right questions and demanding a level of honesty and transparency from our leaders.
The current system does not work. We need to remove the MONEY from the hands of the politicians and create a better economics & finance ministry to handle our nation’s wealth. Guidelines need to be put in place to make it impossible or at least difficult for individuals in government to gain access to the country’s wealth.
Most importantly, we as Nigerians need to change our culture of ME MYSELF AND I, and start thinking of the greater good for the future of OUR COUNTRY. Why is it difficult for GEJ supporters to see dat inefficient power sector poses larger economic threat to our nation than d sustainance of subsidy. If subsidy is removed and our power sector is not fixed we’ll b back to square1. Livi Ajuonuma has always been been a govt apologist even the days of his now rested NTA programme. He used to devote much of his airtime to attacking Oshiomole labor and the civil society during subsidy protests and strikes. I guess he was using guile to solicit govt patronage. KPMG, are u under any oath of confidentiality, if u aren’t, pls confirm the report. Or the member of staff that are nigerians and worked on this audit should please help us. Now, how do we get this message to channels and silverbird and BBC and CNN and get them to air it? If u know how, pls do it. I think KPMG is a reputable firm as revealed by their audit. I wonder why they did not yield to bribe? neverthelesss, this report shows the monumental corruption of NNPC which now leads to punishing innocent Nigerians. Revelations like this is not new to us. I would not be wrong to say it has become a way of life for us. Curruption has eaten so deep into our system that one hardly finds a honest person in the society. if not, how can one explain the fact that a whole director with the world bank in person of MADAM OKONJO IWEALA NGOZI will leave her exalted position and be involved in impoverishing her subject. Those she claimed she wanted to come and serve.
